Tort Reform Needs To Be Done At Federal Level



There are many aspects of healthcare as it relates to physicians that are federally regulated. This started with the Flexner Report in 1910. Look at the FDA and the license for physicians to prescribe controlled substances.
Medical boards across the nation now cooperate by reporting to the National Practitioner Data Bank so bad doctors cannot hop from one state to the next. Without liability reform, the maldistribution of doctors will be exacerbated with more doctors going to states with reform and non-economic damages caps. The states cannot and will not take care of this themselves. That is why federal reform is required.
